BREEDERS’ CUP – TOURNAMENT EDITION
approved for operation in Minnesota
Minnesota gaming laws updated legalizing the operation of Breeders’ Cup machines

San Jose, Calif., –UltraCade Technologies, the world’s leading manufacturer of classic multi-game video machines, announced today that recent legislation changes to the Minnesota Gaming Act will permit its Breeders’ Cup – Tournament Edition game to be legally operated throughout the state of Minnesota.

In 2003 many operators installed Sega’s coin-operated horse racing games into locations throughout the state of Minnesota.  Soon thereafter the state’s gaming law enforcement division forced the removal of the machines which they considered gambling devices.  “They assumed that since the games were representing horse racing, that they were gambling related, and considered the operation of the game a criminal offense,” stated David R. Foley, CEO of UltraCade Technologies.  “Obviously everyone in the industry was concerned about this treatment.  Our Breeders’ Cup game, and the Sega game do not offer any way for a player to win extra credits or place bets on races.“

 

Sega initiated a coordinated lobbying effort in the Minnesota House and Senate focused on changing the Minnesota Criminal Code’s definition of a video game of chance.  Gambling has been a controversial legislative issue in Minnesota and caused concern among legislators who feared it represented a relaxation of gambling regulation and could be used as a legislative vehicle for an expansion of gambling in their state. An omnibus bill was passed in the state Senate 55 to two votes and in the House 114 to 20 votes, May 23, 2005, less than an hour before the end of the session at midnight. 

 

The legislation will allow for the immediate installation and operation of horse racing games so long as they meet the criteria of the law.  The specific language in the Minnesota Gaming Act was modified to state; a video game that simulates horse racing and does not involve a prize payout is not an illegal video game of chance.
